Alternative Dispute Resolution ADR

Alternative Dispute Resolution is a substitute for conventional court settlements. Lawyers use different methods to sign a settlement without the intervention of the court relating to your commercial and personal disputes. Litigation can be an expensive and time-consuming drain on resources, particularly if you are a private individual.

Negotiation

Negotiation

Negotiation is the most informal and flexible method of resolving commercial disputes. Parties or their representatives (Lawyers) discuss the matter. They meet together twice or more to reach agreement resolving the issue.

Mediation

Mediation

Mediation requires the involvement of a licensed mediator. A mediator is a skilled independent facilitator who works impartially with all concerned. In many countries’ mediation is seen primarily as an alternative to court. It avoids court proceedings, helping parties reach a conclusive and mutually satisfactory agreement. It usually also substantially reduces costs. Once an agreement is reached it is irrevocable and legally binding and is registered with the court.

Arbitration

Arbitration

Parties engaged in an arbitration require early specialist professional advice to secure compliance with institutional rules, in accordance with Spanish, EU or Latin American regulations. Arbitration is often the preferred method of resolving disputes within construction, commercial transactions and sport. Our Arbitration lawyers have decades of experience in resolving complex disputes in Spanish and international matters.

EU Post-Brexit

Post-Brexit matters with enforcement of English judgments in EU Member States

No automatic recognition and enforcement.

  • Individuals and small businesses are being affected from the Brexit transition on 31 December 2020 in the UK and freedom of movement to the continent has come to an end. Brexit also impacts matters including enforcement of judgments in civil and commercial matters, EU legal professional privilege, tax and data flows.

The Trade and Cooperation Agreement between UK-EU did not include any provisions to help preserve the pre-Brexit status quo with regards to EU cross-border civil litigation processes. It will not, however, affect the enforceability of English arbitration in Spain.
